And more than ever, it proposes a vision in which data centers are defined not by a computer architecture, be it mainframe or PC server farm, but around the network itself. That makes sense. After all, almost every kind of software is evolving from something that was written for a particular computing platform, into something that is written to be delivered as a service via the Internet. And not static services, either, but ones that can be adapted at a moment's notice on a users' whim—say, by adding a new widget to Facebook, or a new customer order on Salesforce.com. These days, the communication of information—not just the processing of information—is where the action is. Specifically, the company announced the Nexus 7000, its biggest upgrade of the basic corporate network switch since Cisco started selling its now-ubiquitous Catalyst line in the mid-1990s.

This week, along with our co-counsel, EFF filed a motion for judgment on the pleadings asking a U.S. District Court judge to throw out a copyright infringement suit brought by talk show host Michael Savage against the Council on American-Islamic Relations. Savage sued CAIR in December, alleging that CAIR infringed the copyright in his show when it posted on its web site brief excerpts from Savage's radio program in order to criticize Savage's remarks. Savage also added a federal racketeering claim stemming from that alleged copyright infringement.

CAIR's use of the radio program excerpts is, of course, protected under the fair use doctrine. The Copyright Act specifically makes clear that third parties may utilize copyrighted works for purposes of commentary or criticism, as CAIR did in this case.

e-Commerce Shopping Cart Software Integrates Help Desk Support System

ViArt.com, an online company supplying e-commerce shopping cart software to more than 200 customers worldwide, provides users with an integrated help desk support system.

Stokesley, UK (PRWEB) October 24, 2006 -- ViArt (http://www.viart.com) has developed their e-commerce shopping cart software to provide users with a form of customer support. The help desk support system comes in the design of an email support system, which enables customers to fill in an online form with a question or query. The emails are then stored within the help desk for a member of the administration team to assess.

The e-commerce shopping cart's integrated help desk support system accommodates many features to make the customer support service as regulated as possible.

"The emails that come through to the help desk support system can be set up into several categories and assigned an individual manager, as default these are: answered, awaiting response, investigating, proposed solution, closed, new and request more information.

Not a movie-script ending, but a feel-good story nonetheless

Q: I heard that there was a "Hoosiers" type school in the 1B boys tournament last week in Yakima. Tell me about it.

A: Fun story but it doesn't have a magical ending. No player named Jimmy said, "I'll make it" in the huddle in the final minute of the title game.

In fact, tiny North River High School was eliminated after two games, but just getting to the tournament was a feel-good accomplishment that makes you smile.

North River has 24 students in grades 9-12 and a backwoods location about 25 miles southeast of Aberdeen in Brooklyn, Pacific County.

North River suspended varsity basketball for boys and girls in the 1970s until the 2004-05 season because its teams were outmanned. The Mustangs made do with a schedule against JV and sophomore teams.

Jassowal to have world class tennis stadium

Saran said, "The stadium would entirely be dedicated to the development of tennis. Players shall be spending a little from their pockets in order to avail themselves of these services.

"We cannot expect good results until we provide players with the same kind of facilities as their counterparts across the globe get. The country has always been full of talent, what we lack is infrastructure and by constructing this stadium, I believe, I will be able to pay back what this village and country has given me," said Saran.

He further said, "I do not need any financial support from government or any other organisation, though I feel visits by senior politicians of Punjab will go a long way in encouraging and motivating young players besides giving impetus to other such ventures by NRIs thus leading to overall growth and development of Punjab.

Kentucky Chamber announces 'New Agenda' results

The initiative, launched last April, was designed to encourage Kentuckians to suggest ways to improve the state, and funnel those ideas into an action agenda that will be presented to Gov. Steve Beshear and other policy officials.

A task force of business executives and entrepreneurs was formed to guide the process of developing the agenda and help solicit ideas from the public through a designated Web site, community meetings, outreach to civic organizations and community groups, and interviews with experts and opinion leaders.

The task force was led by Craig Grant, regional president of PNC Bank, and included local business leaders such as Ed Glasscock, co-managing partner of Frost Brown Todd LLC; Joan Coleman, president of AT&T Kentucky; Sean O'Leary, CEO of Genscape Inc.; Steve Sexton, president of Churchill Downs; Chris Spalding, president of the Young Professionals Association of Louisville; and Stephen Williams, president and CEO of Norton Healthcare Inc.
